A local diary farm was charged with violating state water
quality standards after last week’s heavy rains allegedly washed
manure off a field and into a tributary feeding the Owasco and
Skaneateles lake watersheds.

The Oswego County Department of Planning and Community Development (1995) identified sand and gravel mines as a potential hazard within the wellhead protection area, which was established to protect our drinking water supply (Sand Ridge Aquifer). The proposed mining operation undoubtedly poses potential threats to groundwater quality and public health, including but not limited to, the following: · Any chemical or fluid materials that are used, disposed of or stored on the land have the potential to leach into the groundwater and contaminate the community water supply. · Clearing of vegetation and soil reduces the lands natural ability to filter pollutants, resulting in reduced groundwater quality. Contaminants on the surface can rapidly infiltrate into the groundwater and move horizontally toward a well. · Erosion and sedimentation caused by the loss of vegetation can adversely affect aquatic habitats (i.e. lakes, ponds, streams, rivers) and wetlands that many organisms rely upon for survival. · Dust emissions are inevitably a problem to area residents. Dust particles originate from mine and motor vehicle traffic, use of hauling roads, and windblown disturbed areas. Dust can contain contaminants, such as toxic heavy metals, which adversely impact air quality and resulting public health. · Heavy truck traffic causes increased safety hazards and damage to public roads. The current zoning and well protection in-place provide regulations to control land use practices that have a potential to adversely impact groundwater quality. Protecting our natural resources (i.e., aquifer/groundwater) and preventing future contamination of our valuable water supply are important to the health of the town and village residents and necessary for economic stability and responsible growth of the Town of Schroeppel and Village of Phoenix. Please show your support by saying NO to the proposed commercial mining operation during the Town Board’s Public Hearing to be held at 6:05 p.m. on June 2, 2011 at the Town Hall located at 69 County Route 57A; Phoenix, NY. 13135.
“Oswego County continues to possess high quality water supplies and an impressive diversity of species and habitats. The major environmental threat is from development near the most sensitive of these valuable resources. This threat has increased with the recent national economic downturn, which has generated pressure to increase local tax revenues whenever and wherever possible. The primary role of local decision-makers should be to evaluate development and projects in light of potential environmental impacts and to attempt to promote development compatible with the area’s resources.” (Oswego County Environmental Management Council, April 2010) |

Having lived across the road from a similar operation years ago, I was relieved when it was terminated. I even called the DEC a few years ago when they had started removing truckloads from that property only to be told that the owners have the right to remove limited tonnage for years to come. You cannot posssibly even consider this redistricting as an option. The reason we as a community live in Oswego County is the rural nature of the surroundings. That's also why we pay such exorbatent taxes as we decided to live in a rural environment. Listening to a commercial operation, dealing with the transportation of the product, dangers to the watershed are more than we are willing to accept. If you consider the residents at all, listen to your conscience and vote against the gravel pit. |

First was a zoning ordinace change to try and get a strip mall placed adjacent to my property, next was a go-cart track less than a half mile away with the promise that it will not make noise. Following that is the Ethenol facility just down the way on Kline Drive, and the subsequent "low income housing" for the low wage earners who would staff that facility, that was already started on a wetland less than a half mile away from my home by one of our neighbors who seems to have an inside track on what is going on. Now I have to deal with a gravel pit... noise, pollution, possible infiltration of my well water... who is serving ME on the board... ANYONE???? I have lived in the same spot here for over 25 years. I live here because it is a rural area with wonderful access to facilities nearby. It seems that EVERY "improvement" that comes before the board does nothing but adversely effect MY lifestyle and the value of my home. I am 100% against this gravel pit. It will change our beautiful area forever in a very bad way. In essence.."Not in MY back yard" |

Rt. 12, in a quiet, well maintained neighborhood. The surrounding area is what attracked me to move here. If this mine is allowed to become operational this will come to end. Not only will my property decrease in value, it will harm the river and natural habitat that is all around us. I, along with many others may be forced to consider selling our homes for far much less than what they are worth. Not only will we have lost our comfortable homes but the county, town and local businesses will suffer. Most important is my grandaughter who lives less than 1 mile from this same area. She drinks and bath's in the water that will become contaminated. The air she breaths will be filled with dust and dirt that could cause serious health issues for her and all other children (and adults of all ages) in the area. Would AJ Montclair Inc. move to this area with their children, grandchildren, mother,father to drink the water and breath the air? I doubt it! I vote no. |

The Town of Schroeppel will be holding a final public hearing on April 28, 2011 to discuss a proposed industrial mining operation on County Route 12. The proposed 30 acre mine would be located in a rural residential area nestled between County Route 12 and County Route 10 as well as adjacent to Pleasant Lake. With
the intent of starting an industrial mining operation, Mr. Montclair
purchased the property and has now requested to REZONE his parcel of
land to allow for industrial mining and to REMOVE the parcel from both
the Aquifer Protection and Wellhead Protection Overlay Districts, which
were established to protect the Sand Ridge Aquifer, the principal water
supply for the Village of Phoenix and Town of Schroeppel.
The Oswego County Department of Planning and Community Development (1995) and NYS Department of Health (2003) have claimed that sand and gravel mines within the Wellhead Protection Overlay District
are a potential source of contamination to the Sand Ridge Aquifer, our
sole source water supply. The proposed modifications to the zoning and
Aquifer Protection and Wellhead Protection Overlay Districts would adversely affect the environment and community, as follows:
The
current zoning and wellhead protection in-place provide regulations to
control land use practices that have a potential to adversely impact
public health (air and water quality), safety, and welfare of the residents. Protecting
our natural resources (i.e., aquifer, wetlands, etc.) and preventing
contamination of our vital water supply are important to the health of
the village and town residents and necessary for economic stability and
responsible growth of the Town of Schroeppel and Village of Phoenix.

The roads to the area in question, while country roads, are designed for rural trafic, and it is doubtful that they would sustain the intense load by multiple gravel trucks daily. With respect to the water supply, see comments from Vincent J. Lucid, Ph.D. The tax base in Schroeppel is highly dependent on the residential population. A short term commercial contract (initially 5 years) with a potential adverse impact to the water supply would adversely impact the tax base by devaluing housing prices. Then the only recourse would be to connect to OCWA, which would take many years to install at individual tax payer expense. Based on this, I recommend against approval of this petition See Comments below from Vincent J. Lucid, Ph.D. It odesn't appear that the requisite research has been completed to validate that the aquifer will not be impacted. A short term commercial venture (5 years) which adversely impact the aquifer and Pleasant Lake is not conducive to the tax base in the long term. As one responder stated, the area is dependent on well water, and connection to OCWA to replace well water would be many years in the development, at taxpayer expense. |

Not to mention the environmental impacts via dust, noise, wildlife etc. and the damage to County Rts 10&12 and Center Rd. resulting from numerous trucks loaded with gravel. These roads were not built to withstand this type of commercial use. I vote NO to allowing this project to be approved. |

Clients would hire me to prepare the environmental permit applications for proposed projects like this one. If I worked on this project, I would be obliged to advise my client that the process is costly, and in this case it is unlikely that the applications would all be approved. The wetland that would be crossed by the access road is regulated at both the Federal and State levels. In addition to the zoning change, a Section 404 wetlands permit is needed from the US Army Corps of Engineers. At the State level, the NYSDEC requires a mining permit, a Section 401 Water Quality Certification and a Section 7 Wetlands Permit. Wellhead protection is an obvious water quality concern. Furthermore, Wetland BR-1 is a Class I Wetland. The NYSDEC is very reluctant to grant permits for encroachment on such wetlands. I doubt that the NYSDEC has been made aware that a portion of this wetland is kettle bog. I suspect that this agency soon will become aware of this fact. There is a little-known cluster of seven bogs in this vicinity. As far as I know, these are the southernmost kettle bogs in New York State. I did an inventory of these unusual plant communities in 2000 for "Save The County". I observed plants more characteristic of the Adirondacks than of Central New York: sphagnum, pitcher-plants, leather-leaf, cotton-grass, blueberry and black spruce. At that time, Save-the-County was exploring the possibility of purchasing some parcels of to protect the bogs from land uses (like mining operations, for example) that would threaten these noteworthy plant communities. I am submitting this statement in writing to the Town of Schroeppel Planning Board at their meeting on March 10, 2011.
